TERMS OF SERVICE
1. GENERAL TERMSThe Client/Commissioner:
• Will only get a digital product, not a physical product.
• Is not allowed to ask the artist to draw in a different style.
• Is obligated to state if the commission product will be used for commercial purposes. Please be honest.The Artist:
• Has the right to decline or cancel a commission at any time.
• As an artist, my art keeps evolving, so there might be slight differences between the samples in my gallery and the illustration you will receive.
2. PROCESS & DELIVERY• Once a commission request is accepted, the artist will notify the client through e-mail to confirm the final price.
• The client must reply to confirm the order, together with their PayPal address.
• Once the order is confirmed, the artist will send a Paypal invoice to the client.
• Once the payment is received, the artist will notify the client that the commission has started, at which point the client loses the right to get a refund.
• A commission can take from 1 month up to 3 months, depending on the type and complexity of the commission piece, or personal matters.
• Once the commission piece is finished, the artist will send a file (~3000 x 3000 px) delivered digitally, in both PNG and JPEG formats.
3. PAYMENT• Payment is done through Paypal, using USD as currency.
• The artist will request payment through an Invoice to the client's Paypal address to avoid accidental transactions.
• The artist requires full payment before starting to work on the commission.
• Payment is expected to be received in terms of 48 hours after the artist sends the invoice.
• If the client isn't able to pay in time, they are required to let the artist know beforehand.
• If the commissioner intends to use the product for Commercial Use, the price will be discussed and increased.
4. CHANGES & EDITS• The client can request to see the sketch before the artist continues the commission piece.
• The client can ONLY request minor changes. Major changes will come with an extra fee.
• The evaluation of minor/major changes is done upon the artist's opinion.
5. CANCELLATION & REFUND POLICY• The client is not allowed to ask for a refund once the commission has started unless there is a good reason for it (e.g.: serious financial problems).
• If the order is canceled before the commission is started, the client will get a full refund.
• In case of a refund, the artist will send the money back through Paypal.
• If the client requests a Paypal chargeback at any point when they were not allowed to ask for a refund, they will lose all rights to the commissioned piece and the artist will have the full rights to profit further from it in any way. The respective client will be blacklisted and will not be able to commission the artist again.
6. COPYRIGHT & USAGE POLICYThe Client / Commissioner:
• May use the commissioned piece for personal uses (icons, wallpapers, personal page/site displays, etc.).
• May upload the commissioned piece on any personal website as long as it is credited to the artist.
• May use the commissioned piece for commercial purposes, only if they stated so and after it was discussed with the artist. (reselling, making prints, promotional materials, CD cover, business card, including YouTube/Twitch/Patreon/store assets).
• May NOT change or modify the commissioned piece without the artist's consent.
• May NOT take credit for the commissioned piece.The Artist:
• Retains all copyrights over the commissioned piece, which includes the right to publish, redistribute, reproduce, or use as a sample for sales/self-promotion, etc.)
• Will not publish the piece anywhere online if the client chooses a private commission.
